Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the mycote.com website (the "Service") operated by mycote ("we", "us" or "our").
Your access to and use of the Service is subject to your acceptance of and compliance with these Terms and Conditions. These conditions apply to all visitors, users and other persons accessing or using the service.
By accessing or using the service, you agree to be bound by these terms and conditions. If you disagree with any part of the terms, you cannot access the service.
The Service is billed on a subscription basis ("Subscription(s)"). You will be invoiced in advance on a recurring and periodic basis ("invoicing cycle"). Billing cycles are defined on a monthly or annual basis, depending on the type of subscription you selected when you purchased a subscription.
At the end of each billing cycle, your subscription will automatically be renewed under the same conditions, unless you cancel it or mycote cancels it. You can cancel the renewal of your subscription by contacting [email protected] or by contacting mycote technical support.
In the event of failure of automatic invoicing for any reason whatsoever, mycote will issue an electronic invoice indicating that you must proceed manually, within a given period, with full payment corresponding to the invoicing period indicated on the invoice.
Mycote, at its sole discretion and at any time, may change the subscription fees for subscriptions. Any change in subscription fees will take effect at the end of the current billing cycle.
Mycote will inform you in advance of any change in subscription fees to allow you to terminate your subscription before the change takes effect.
Your continued use of the Service after the change in subscription fees takes effect constitutes your agreement to pay the amount of the changed subscription fees.
Mycote offers a 30-day satisfaction guarantee. If, for any reason, you are not satisfied with the service, please contact us at [email protected] for a full refund.
Our service allows you to publish, link, store, share and make available certain information, text, graphics, videos or other material ("Content"). You are responsible for the content you publish on the service, including its legality, reliability and adequacy.
By posting content on the Service, you grant us the right and license to use, modify, perform, display, reproduce and distribute such content on and through the Service. You retain all your rights to any Content you submit, publish or display on or through the Service and you are responsible for protecting those rights.
You represent and warrant that: (i) the Content is yours (you own it) or you have the right to use it and grant us the rights and license provided for in these Terms and Conditions, and (ii) the display of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contractual rights or any other rights of any person.

Termination of contract
We may terminate or suspend your account immediately, without notice or liability, for any reason, including without limitation if you do not comply with the Terms.
In the event of termination, your right to use the Service will cease immediately. If you wish to terminate your account, you can simply stop using the service.
All provisions of the Conditions which, by their nature, should survive termination shall survive termination, including, without limitation, ownership provisions, warranty waivers, indemnification and limitations of liability.
You agree to defend, indemnify and hold harmless Mycote, its licensee and licensors, and their employees, subcontractors, agents, directors and officers, from and against all claims, damages, obligations, losses, liabilities, costs or liabilities, and expenses (including, without limitation, legal fees), resulting or resulting from: a) your use of and access to the Service by you or anyone else using your account and password; b) a breach of these terms and conditions, or c) content posted on the Service.
Limitation of liability
Mycote, nor its directors, employees, partners, agents, suppliers or affiliates, shall be liable for any indirect, incidental, special, consequential or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from (i) your access, use or inability to access or use the Service; (ii) any conduct or content of a third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or modification of your transmissions or content, whether based on a warranty, contract, tort (including negligence) or other legal theory, whether or not we have been advised of the possibility of such damages,

Exclusions and exclusions
Without limiting the generality of the foregoing and notwithstanding any other provision of these Terms and Conditions, in no event shall Mycote be liable to you or any other person for any indirect, incidental, consequential, special, punitive or exemplary loss or damage arising out of, in connection with or related to your use of the Service, these Terms and Conditions, the subject matter of these Terms and Conditions, the termination of these Terms and Conditions or otherwise, including but not limited to personal injury, loss of data or business, markets, savings, revenues, profits, use, utilization, use, production, reputation or goodwill, whether anticipated or not, or economic loss, under any theory of liability (contractual, tortious, strict liability or any other theory or law or equity), regardless of any negligence or other fault or wrongful act (including, without limitation, gross negligence and fundamental breach) by Mycote or any person for whom it is responsible and even if Mycote has been informed of the possibility that such loss or damage may occur.
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such rights. If any provision of these Terms and Conditions is found by a court to be invalid or unenforceable, the remaining provisions of these Terms and Conditions shall remain in full force and effect. These Terms constitute the entire agreement between us regarding our service, and supersede any prior agreements we may have between us regarding the service.
Changes in the system
We reserve the right, at our sole discretion, to modify or replace these terms and conditions at any time. If a revision is significant, we will try to give at least 30 days' notice before new conditions come into effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our service after these revisions take effect, you agree to be bound by the revised terms and conditions. If you do not accept the new terms and conditions, you must stop using the service.
